This rule affirms that schools cannot categorically ban trans students from playing sports consistent with their gender identity – but it still leaves trans, non-binary, and intersex student athletes vulnerable to discrimination. Vague language in the proposed rule opens the door for extremist lawmakers to restrict participation in sports for trans, non-binary, and intersex students. The rule needs more clarity on how Title IX protects the rights of all students to play sports.

Without explicit prohibitions on invasive sex “verification” procedures, the new Title IX proposed rule from the Biden Administration leaves all women and girls, and particularly women and girls of color, vulnerable to racist, transphobic discrimination.
